Terms of Service

1. Who we are and what these Terms cover
These Terms are entered into between you (“you” or “User”) and Jiangmen Jiuxin New Energy Technology Co., Ltd. (“Yuejiujiu”, “we”, “us” or “our”), a company established in Jiangmen City, Guangdong Province, China.
They govern your use of:
- our website at https://www.yuejiujiutricycle.com/ (the “Website”), and
- our tools and services that connect to third-party social media and video platforms to publish or manage content on your behalf (the “Service”).
Your use of the Website and Service is also governed by our Privacy Policy, which explains how we handle personal information. If there is a conflict between these Terms and the Privacy Policy on the subject of personal information, the Privacy Policy prevails.
2. Eligibility
You must have the legal capacity to enter into a contract in your jurisdiction, and you must be at least 18 years old (or the age of majority where you live) to use the Service. If you are using the Service on behalf of a company or other organisation, you confirm that you are authorised to bind that organisation to these Terms.
3. Your account and platform connections
- You are responsible for the accuracy of information you provide and for keeping any credentials secure.
- When you connect a third-party platform (such as YouTube, TikTok, Pinterest, LinkedIn, Meta or X), you authorise us to access and act on that account only within the permissions you approve, and only to carry out the actions you instruct.
- You must have the right to post content to any account you connect, and the right to grant us those permissions.
- You may disconnect any platform at any time, either from within the Service or on the platform itself. Instructions are in our Privacy Policy.
4. Your content
You retain all rights in the videos, text, images and other materials you submit (“User Content”). You grant us a limited, non-exclusive, revocable licence to host, transmit and publish your User Content solely as necessary to provide the Service to you.
You represent and warrant that:
- you own your User Content or otherwise have all rights necessary to publish it;
- your User Content does not infringe the copyright, trademark, privacy, publicity or other rights of any person;
- your User Content complies with applicable law and with the terms and community standards of each platform to which it is published.
We do not claim ownership of your User Content and we do not publish it anywhere except the platforms you have explicitly selected.
5. Acceptable use
You agree not to use the Website or Service to:
- violate any applicable law or regulation;
- infringe or misappropriate the intellectual property or other rights of any person;
- upload or publish content that is unlawful, defamatory, deceptive, harassing, hateful, obscene, or that exploits minors;
- distribute malware, spam, or unsolicited commercial messages;
- impersonate any person or entity, or misrepresent your affiliation with one;
- attempt to gain unauthorised access to the Service, other accounts, or related systems, or interfere with their operation;
- circumvent any rate limit, quota or security mechanism of a connected platform;
- resell, sublicense or provide the Service to third parties without our prior written consent.
6. Third-party platforms
The Service interoperates with independent third-party platforms that we do not control. Your use of each platform remains subject to that platform's own terms of service, developer policies and community standards. We are not responsible for changes to a platform's API, for its availability, or for any content moderation, removal, restriction or account action taken by a platform.
Where we access Google APIs on your behalf, our use and transfer of information received from those APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.
7. Product information and quotations
Product descriptions, specifications, drawings and prices shown on the Website are provided for general information. They do not constitute a binding offer and may change without notice. Any sale of products is governed by a separate written contract or pro forma invoice agreed between the parties.
8. Intellectual property
We (or our licensors) own the Website and Service, including their software, text, layout, graphics, logos and trademarks, other than your User Content. Except as permitted by law or with our prior written permission, you may not copy, modify, distribute, reverse engineer or create derivative works from any part of the Website or Service. The Yuejiujiu name and logos are our trademarks.
9. Availability and changes to the Service
We aim to keep the Service available but do not guarantee uninterrupted operation. We may modify, suspend or discontinue any part of the Service, and may update these Terms, to reflect changes in the law, the Service, or the requirements of connected platforms. Where a change is material, we will take reasonable steps to notify you and will update the “Last updated” date above. Continued use after changes take effect constitutes acceptance.

11. Limitation of liability
To the maximum extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunity, arising out of or relating to your use of (or inability to use) the Website or Service, even if we have been advised of the possibility of such damages.
To the maximum extent permitted by applicable law, our total aggregate liability arising out of or relating to these Terms or the Service, whether in contract, tort or otherwise, is limited to the greater of (a) the amounts you paid us for the Service in the 12 months preceding the event giving rise to the claim, or (b) USD 100.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
12. Indemnity
To the extent permitted by applicable law, you agree to indemnify and hold us harmless from any claim, demand, loss, liability, damage, cost or expense (including reasonable legal fees) arising out of your User Content, your use of the Service, your breach of these Terms, or your violation of any law or the rights of a third party.
13. Termination
You may stop using the Service at any time and may disconnect any platform connection. We may suspend or terminate your access if you breach these Terms, if required by law, or if a connected platform requires it. On termination, the provisions of these Terms that by their nature should survive (including sections 4, 8, 10, 11, 12 and 14) will continue to apply.
14. Governing law and dispute resolution
These Terms are governed by the laws of the People's Republic of China, without regard to conflict of laws rules. The parties will first attempt to resolve any dispute through good-faith negotiation. If a dispute cannot be resolved within 30 days, it will be submitted to the competent court in Jiangmen City, Guangdong Province, China. Nothing in this section prevents either party from seeking injunctive or other equitable relief, or affects any mandatory consumer rights you may have under the law of your country of residence.
15. General
- Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and us regarding the Website and Service.
- Severability. If any provision is held unenforceable, the remaining provisions remain in effect.
- No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
- Assignment. You may not assign these Terms without our consent. We may assign them as part of a merger, acquisition or sale of assets.
